Executive Order to Reduce Regulations and Regulatory Costs Challenged in Court
On Feb. 8, 2017, Public Citizen, the Natural Resources Defense Council and the AFL-CIO filed a lawsuit challenging President Trump’s Executive Order, “Reducing Regulation and Controlling Regulatory Costs.” The order requires agencies that propose new regulations to identify at least two existing regulations to be repealed and any costs of a new regulation must be offset by the elimination of costs associated with the two regulations identified for repeal. In addition, for fiscal year 2017, the executive order requires the total cost of new regulations to be zero. The plaintiffs argue that the President exceeded his constitutional authority in issuing the order and that the order will have negative consequences for the public and environment.
